1. About Hidden Gibraltar

Hidden Gibraltar (“we”, “us”, “our”) operates an online platform that curates and facilitates bookings for experiences in Gibraltar.

Hidden Gibraltar:

• Does not own, operate, manage, or control any tours or activities.
  
  
• Does not employ or supervise guides or experience providers.
  
  
• Acts solely as an intermediary booking platform connecting customers with independent third-party operators (“Experience Providers”).
  
  

All experiences are delivered by independent Experience Providers.

2. Acceptance of Terms

By accessing our website or making a booking, you confirm that:

• You have read and understood these Terms & Conditions.
  
  
• You agree to be legally bound by them.
  
  
• You are at least 18 years of age, or are booking on behalf of a minor for whom you are legally responsible.
  
  

3. Bookings & Payments

• All bookings are made through our website.
  
  
• Full payment is required at the time of booking unless otherwise stated.
  
  
• A booking is only confirmed once payment has been successfully processed.
  
  
• Confirmation will be sent via email.
  
  
• Prices may change at any time prior to booking confirmation.
  
  
• We reserve the right to correct obvious pricing or availability errors, including after a booking has been submitted.
  
  

If a pricing error is identified, we may:

• Offer the booking at the correct price, or
  
  
• Cancel the booking and issue a full refund.
  
  

4. Independent Experience Providers

All experiences are delivered by independent third-party Experience Providers.

Experience Providers are solely responsible for:

• Conducting and delivering the experience
  
  
• Safety standards and risk management
  
  
• Insurance coverage
  
  
• Compliance with local laws and regulations
  
  
• Staff training and supervision
  
  

Hidden Gibraltar does not supervise, control, or direct how experiences are conducted.

Any claims relating to the operation or delivery of an experience must be directed to the relevant Experience Provider.

5. Assumption of Risk

PLEASE READ THIS SECTION CAREFULLY.

By booking or participating in any experience, you acknowledge and agree that:

• Participation involves inherent risks.
  
  
• Outdoor and public-environment activities carry unavoidable risks.
  
  
• Risks may include (without limitation): slips, trips, falls, collisions, traffic interaction, uneven terrain, weather exposure, food-related reactions, and third-party actions.
  
  

You voluntarily assume all risks associated with participation.

Participation is entirely at your own risk.

6. Personal Responsibility

You agree that:

• You are responsible for assessing whether an experience is suitable for you.
  
  
• You are responsible for your own safety and for minors in your care.
  
  
• You will follow all instructions given by the Experience Provider.
  
  
• You will wear appropriate clothing and footwear.
  
  
• You will disclose relevant medical conditions, injuries, allergies, or mobility concerns before the experience begins.
  
  

Failure to follow instructions may result in removal from the experience without refund.

7. Limitation of Liability

To the maximum extent permitted by Gibraltar law:

Hidden Gibraltar shall not be liable for:

• Personal injury
  
  
• Death
  
  
• Property damage
  
  
• Loss of personal belongings
  
  
• Delays or disruptions
  
  
• Acts, omissions, negligence, or breaches of Experience Providers
  
  
• Weather conditions
  
  
• Force majeure events
  
  
• Any indirect, incidental, consequential, or special damages
  
  
• Loss of profits, revenue, goodwill, or opportunity
  
  

Our total aggregate liability, where liability cannot legally be excluded, shall not exceed the amount paid by you for the specific booking giving rise to the claim.

Nothing in these Terms excludes liability where it would be unlawful to do so.

8. No Warranties

All services, website content, and experiences are provided “as is” and “as available”.

We make no warranties or representations regarding:

• Accuracy of descriptions
  
  
• Suitability of experiences
  
  
• Availability
  
  
• Weather conditions
  
  
• Safety performance of Experience Providers
  
  
• Third-party content
  
  

To the maximum extent permitted by law, all implied warranties are disclaimed.

9. Cancellations & Refunds

All bookings are non-refundable unless otherwise stated.

Refunds may only be issued where:

• The Experience Provider cancels the experience
  
  
• Severe weather or safety issues make operation impossible
  
  
• A technical or operational failure prevents the experience from taking place
  
  

In such cases, customers will be offered:

• A rescheduled date, or
  
  
• A full refund where rescheduling is not possible
  
  

Refund decisions related to operational or safety issues are made by the Experience Provider.

Hidden Gibraltar is not responsible for customer cancellations due to personal reasons, missed attendance, transport delays, illness, or change of plans.

10. Changes to Experiences

Experience details, routes, timings, or guides may change due to:

• Safety requirements
  
  
• Operational needs
  
  
• Weather
  
  
• Regulatory requirements
  
  

Such changes do not constitute grounds for refund unless the experience is materially altered or cancelled.

11. Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including but not limited to:

• Government action
  
  
• Strikes
  
  
• Natural disasters
  
  
• Public health events
  
  
• Transportation disruptions
  
  

12. Indemnification

You agree to indemnify and hold harmless Hidden Gibraltar, its owners, directors, affiliates, and representatives from and against any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of:

• Your negligence or misconduct
  
  
• Your participation in any experience
  
  
• Claims brought by third parties arising from your actions
  
  

This clause does not apply where prohibited by applicable consumer protection law.
